Jennifer Middleton, staff attorney for the Lambda Legal Defense and Education Fund, tells us about the unfortunate ruling on March 15 by the Kansas Supreme Court in the J'Noel Gardiner case and its implications. J'Noel Gardiner, a transsexual woman whose husband died and who was sued by his son for her balance of the estate, was declared a man, and therefore not legally married to her husband, by the court.

Question of the week
" Hi, I am a 19 year-old pre-hormones/pre-body modification transsexual Filipina woman. I consider myself as a transactivist in a country wherein there's not even a transgender/transsexual identified organization. I am giving informal lectures on trans issues and try to raising trans awareness. I got a problem when people, especially gays and lesbians here, are equating homosexuality and transsexuality. Can you suggest of a way wherein I can say that I am not "gay" but a "transsexual woman" in a non-aggressive and non- too theoretical way? Also, there are local terms here in my country that I believe means "transsexual" but the LG community has claim them to mean as gay and even "transsexual" has been put under their banner, what can I do with this when I feel my identity is being "erased"? Last one: is sissyphobia same as transphobia? MABUHAY and your show is really great! " (from: Sass, Quezon City, Philippines)
